Short and Fat, I think you're justified as long as you're giving the proper amount of time to let them get over. I hate passing on the right, but you're right, sometimes there's just no choice. I do the same thing.

Tennessee actually adheres more to the Uniform Vehicle Code. Left lanes aren't "passing only" here. "Passing Only" doesn't really make much sense because people need to use those lanes for turning into medians, etc.

Driving in the left lane is fine, but slower-than-normal (regardless of speed limit) traffic is supposed to keep right. So whether the guy in front of you was wrong depends on whether he was impeding the left lane and what the "normal" rate of traffic is there.

More details here: http://www.mit.edu/~jfc/right.html

I'll confess to being a rule breaker. I pass on the right. All of the time. In my defense, I'm practically forced to do it. I wait an acceptable amount of time for the driver in the left lane to realize that they are driving in a moronic fashion. Then I have no choice but pass.

Note: If multiple cars pass you on the right. You drive too damn slow.

Ah, you're totally right about the reminders. I was thinking the other day that folks should be required to pass the written test again every so many years. I can't tell you how many times I've driven down I-24 with some yahoo who is going 55-60 in the left lane...
